Compulsory Portion

The compulsory portion is the statutory minimum monetary claim of close relatives who have been disinherited by will or inheritance contract, or who receive less than their statutory minimum share.

Eligible persons include children, spouses and, in certain cases, the parents of the deceased. The claim is directed against the heirs and is for money, not for specific estate assets. The value of the estate at the time of death is therefore decisive.

In practice, disclosure, estate inventories and valuation are central. Real estate, accounts, business interests and gifts must be recorded carefully so the claim can be calculated realistically or defended against.
