Data Storage

a) When visiting the website

When you access our website www.kswg.de, information is automatically sent by the browser used on your device to our website server. This information is temporarily stored in a so-called log file.

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the retrieved file,
  • Website from which access is made (referrer URL),
  • Browser used and, if applicable, your computer's operating system as well as the name of your access provider.

The aforementioned data is processed by us for the following purposes:

  • Ensuring a smooth connection setup of the website,
  • Ensuring comfortable use of our website,
  • Evaluation of system security and stability, and
  • Further administrative purposes.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f GDPR. Our legitimate interest follows from the purposes for data collection listed above. Under no circumstances do we use the collected data to draw conclusions about your person. In addition, we use cookies and analytics services when you visit our website. Further explanations can be found in the following sections of this privacy policy.

b) When using our contact form

If you have questions of any kind, we offer you the possibility to contact us via a form provided on the website. Providing a valid email address is required so that we know who sent the inquiry and can respond. Additional information can be provided voluntarily.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR on the basis of your voluntarily given consent.

The personal data collected by us for using the contact form will be automatically deleted once your inquiry has been handled.

Disclosure of Data

Your personal data will not be transferred to third parties for purposes other than those listed below. We only disclose your personal data to third parties if:

  • you have given your explicit consent pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR,
  • the disclosure is necessary pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding legitimate interest in non-disclosure of your data,
  • in the event that there is a legal obligation for disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR, as well as
  • this is legally permissible and required pursuant to Art. 6 para. 1 sentence 1 lit. b GDPR for the processing of contractual relationships with you.

Cookies

We use cookies on our website. These are small files automatically created by your browser and stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not damage your device and do not contain viruses, trojans or other malware.

Information is stored in the cookie that is related to the specific device used. However, this does not mean that we immediately obtain knowledge of your identity.

The use of cookies serves to make the use of our services more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These are automatically deleted after you leave our site.

Audience measurement & technical performance data

This website uses "Vercel Web Analytics" and "Vercel Speed Insights" provided by Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA. Both services process technical visit data (e.g. page URL, referrer, approximate region, anonymized device and browser identifiers, and load-time metrics) solely in aggregated and anonymized form. No cookies are set, no device IDs are stored and no personal profiles are created; your IP address is pseudonymized on Vercel's servers upon receipt and is not stored persistently.

The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest lies in statistical audience measurement and in ensuring and improving the technical availability and speed of this website. You may object to this processing at any time under Art. 21 GDPR; an e-mail to info@kswg.de is sufficient.

Data from the Strategy Check

On our home page we offer an interactive Strategy Check that lets you obtain an initial legal classification of your matter via a few targeted questions.

Data processed: During the Strategy Check we process only the answers you select (e.g. legal area, broad situational attributes, the receipt date of a termination letter if applicable) and an optional free-text summary. These entries are initially cached locally in your browser (technically: localStorage) so that you can resume the check or see the summary pre-filled in the contact form. Without you actively submitting the contact form, this information does not leave your device.

Transmission to us: Only when you actively send the contact form, your answers together with the contact details you provided (name, email, phone, preferred office, message) are transmitted to our servers encrypted via TLS 1.2/1.3. Processing is based on Art. 6(1)(b) GDPR for the purpose of preparing a possible attorney-client relationship and, additionally, on your consent under Art. 6(1)(a) GDPR; it is also subject to the lawyer's duty of confidentiality pursuant to § 43a(2) of the Federal Lawyers' Act (BRAO) and § 203 of the German Criminal Code (StGB).

No mandate by the check itself: The Strategy Check does not replace individual legal advice. Using it or submitting the contact form does not yet establish an attorney-client relationship; in particular, no legal deadlines (such as the three-week deadline under § 4 of the German Protection Against Dismissal Act) are preserved. A mandate is only established upon our express confirmation.

Retention: If no mandate is established after your inquiry, we delete your Strategy Check and contact form data no later than three months after submission. If a mandate is established, the data becomes part of the case file and is retained in accordance with the statutory retention obligations applicable to lawyers.

Rights of Data Subjects

You have the right:

  • pursuant to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you may request information about the processing purposes, category of personal data, categories of recipients to whom your data has been or will be disclosed, planned storage period, existence of a right to rectification, erasure, restriction of processing or objection, existence of a right to lodge a complaint, origin of your data if not collected by us, and the existence of automated decision-making including profiling and, where applicable, meaningful information about its details;
  • pursuant to Art. 16 GDPR, to request immediate rectification of inaccurate or completion of your personal data stored by us;
  • pursuant to Art. 17 GDPR, to request deletion of your personal data stored by us, unless processing is required for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defense of legal claims;
  • pursuant to Art. 18 GDPR, to request restriction of processing of your personal data if the accuracy of the data is contested by you, the processing is unlawful but you oppose its erasure and we no longer need the data, but you need it for establishment, exercise or defense of legal claims, or you have objected to processing pursuant to Art. 21 GDPR;
  • pursuant to Art. 20 GDPR, to receive your personal data that you provided to us in a structured, commonly used and machine-readable format or to request transmission to another controller;
  • pursuant to Art. 7 para. 3 GDPR, to withdraw your consent once given at any time with effect for the future. This means that we may no longer continue the data processing based on this consent in the future, and
  • pursuant to Art. 77 GDPR, to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority at your usual place of residence or work or at the location of our law office.

Right to Object

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right pursuant to Art. 21 GDPR to object to the processing of your personal data, provided there are reasons arising from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right to object, which will be implemented by us without requiring a particular situation.

Data Security

During your website visit, we use the widely used SSL procedure (Secure Socket Layer) in conjunction with the highest encryption level supported by your browser. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can recognize whether an individual page of our website is transmitted in encrypted form by the closed display of the key or lock symbol in your browser's lower status bar.

We also use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
